Terms of Service.

Pickford is operated by Lake Missoula Ventures, LLC, a limited liability company organized under the laws of the Commonwealth of Massachusetts. Pickford is a trade name of Lake Missoula Ventures, LLC. In these terms, "we", "us" and "our" mean Lake Missoula Ventures, LLC, and "you" means the person using the service.

Pickford suggests films to watch based on preferences you give us. The suggestions are opinions produced by software, including automated language generation. They are offered for your entertainment and are not professional advice of any kind.

We may change, suspend, or discontinue any part of the service at any time. We may also impose limits on features or restrict access without notice.

You must be at least 13 years old to use Pickford, and old enough to form a binding contract where you live. If you are under the age of majority in your jurisdiction, you may use the service only with the involvement of a parent or guardian.

You sign in with a link sent to your email address. You are responsible for keeping access to that address secure, and for everything that happens through your account. Tell us promptly at hello@pickford.app if you believe someone else is using it.

One person, one account. Do not create an account using an email address you do not control.

You agree not to:

use the service unlawfully or to infringe anyone's rights; scrape, crawl, or harvest data from it by automated means; attempt to gain unauthorized access to any account, system, or data; interfere with or overload our infrastructure; reverse engineer or attempt to derive source code except where that restriction is unenforceable by law; resell, sublicense, or commercially exploit the service or its output without our written permission; or upload anything containing malware or data you do not have the right to provide.

We may suspend or terminate access for any breach of these terms, or for conduct we reasonably consider harmful to the service or to other people.

You keep ownership of everything you give us, including your taste selections and any viewing history you import. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, and use that material solely to operate and improve the service for you.

You confirm that you have the right to provide anything you upload. If you import data from another service, you confirm that doing so does not breach your agreement with that service.

Film information and images come from TMDB. This product uses the TMDB API but is not endorsed or certified by TMDB. Streaming availability is provided by Watchmode. Availability, pricing, and the existence of any title on any service can change without notice, and we do not guarantee that a film shown as available is available to you.

If you connect a public profile from another service, or upload an export of your own data, we read only what you provide or what that service makes publicly available. We never ask for and never store passwords for other services. Your use of those services remains governed by their own terms.

Links to third-party sites are provided for convenience. We do not control them and are not responsible for them.

Parts of the service may be offered on a paid basis. Prices, features, and billing intervals will be shown before you purchase. By purchasing, you authorize us and our payment processor to charge your payment method on the stated schedule until you cancel.

All payments are final and non-refundable, including partial periods, unused time, and periods following cancellation, except where a refund is required by law. Cancelling stops future charges; it does not refund charges already made. You keep paid access through the end of the period you have already paid for.

We may change prices on a going-forward basis. If we do, we will give you notice before the change takes effect, and you may cancel before it does. You are responsible for any taxes other than taxes on our income.

If a payment fails or is charged back, we may suspend paid features immediately.

The service, including its software, design, text, and branding, belongs to us or our licensors and is protected by intellectual property law. We grant you a limited, personal, non-transferable, revocable licence to use the service for your own non-commercial purposes. No other rights are granted.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the service will be uninterrupted, secure, or error free, that recommendations will suit you, or that any information shown, including streaming availability, is accurate or current. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER LAKE MISSOULA VENTURES, LLC NOR ITS MEMBERS, MANAGERS, EMPLOYEES, OR AGENTS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS ($100).

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.

You agree to indemnify and hold harmless Lake Missoula Ventures, LLC and its members, managers, employees, and agents from any claims, damages, liabilities, and reasonable legal fees arising out of your use of the service, your content, or your breach of these terms.

You may stop using the service at any time and may delete your account from your profile. We may suspend or terminate your access at any time, with or without cause. On termination, your right to use the service ends immediately. Sections that by their nature should survive, including sections 5 and 8 through 14, survive.

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Massachusetts for any dispute not subject to another agreed process, and each of us waives any objection to venue there.

Any claim must be brought within one year after it arises, to the extent permitted by law. You and we agree that any dispute will be brought individually, and not as a plaintiff or class member in any class or representative action, to the extent permitted by law.

We may update these terms. If we make a material change, we will update the effective date above and, where appropriate, notify you. Continuing to use the service after a change takes effect means you accept the updated terms.

These terms, together with our Privacy Policy, are the entire agreement between you and us about the service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of assets.
